Husband Of Murder Victim Sues Because Of Dangerous Property

In Pennsylvania or any state, a gated community may be one of the last places a person would expect a gruesome murder to take place. Gated communities typically have secured entrances and fences or walls surrounding the homes to prevent the entrance of strangers. Nevertheless, a family living in such a neighborhood in another state is suing the property’s manager and security detail, claiming the inadequate security actually made their home a dangerous property.

The wall surrounding the community apparently had a gap in it. Police speculate that this gap provided entrance to a 22-year-old man who invaded a family home and stabbed to death the 59-year-old woman who lived there. The woman’s body was found — hands and feet tied — in the bathtub when her son came home. The man accused of killing her was captured 10 days later, escaped while in a courtroom and was recaptured after six days. He faces the death penalty if convicted.

The woman’s husband filed suit against the property manager and security company, alleging they should have known about the breach in the wall. The husband asserts that the manager and security team were responsible for guarding the property against unwanted intruders. Because they assumed the community was well guarded,  residents were given a false sense of security and were not as vigilant.

As with any family in Pennsylvania who feels that a dangerous property contributed to the death of a loved one, the deceased woman’s husband sought the assistance of an attorney. He is seeking over $15,000 in damages from the residential manager and the security company. Maintaining his innocence, the man accused of the murder awaits trial. Meanwhile, no date has been set for the lawsuit.
